This Agreement is between totallyboaty.co.uk Limited (referred to as totallyboaty) and the advertiser (the advertiser being defined as any business providing details to be added to the totallyboaty website whether payment is made or not).
The advertiser is responsible for the accuracy of copy and banners supplied for publication, and for their regulatory compliance. The advertiser agrees to indemnify totallyboaty against any claims made against it as a result of any copy inaccuracy.
totallyboaty reserves the right, in its sole discretion, to change, modify, add or remove all or part of this Agreement at any time. Totallyboaty will notify the advertiser by email (to the email address specified by the advertiser) of any changes to this Agreement
For any fees payable, VAT is payable at the current rate.
Payment of any fees is due monthly in advance of the advertisement or enhanced listing. Upon payment totallyboaty will place the advertisement or enhanced listing for the agreed number of calendar months.
By submitting an entry to totallyboaty the advertiser confirms that they are 18 years of age or older and that they and any third party on whose behalf they are using this website agree to be bound by the terms of this Agreement.
Any information submitted by the advertiser, or any part of the advertiser’s website, must not be of “adult” or “illegal” content. This will result in instant removal of the entry from the totallyboaty website, with no refunds being payable to the advertiser. The advertiser agrees to indemnify totallyboaty against any claims made against it as a result of adult or illegal content submitted by it.
This service is provided without warranty. totallyboaty will take due care to ensure the service remains on-line at all times but will not be held liable in the event that any service disruption however this is caused. Totallyboaty shall not be liable for any loss of service by reason of circumstances or events beyond it’s control.
These terms and conditions are governed by and shall be governed and construed in accordance with the laws of England and the parties hereby submit to the jurisdiction of the English Courts. The advertiser in placing the order acknowledges that it has read and accepted the terms.
The total limit of our liabilities under this agreement shall not exceed the amount of the last monthly payment made to totallyboaty.
This Agreement is a subscription which will automatically be renewed unless cancelled by either party providing the other with at least seven days notice electronically or by post.
totallyboaty can terminate this Agreement at any time in our own discretion by providing the advertiser with seven days notice electronically or by post.
